Pursuant to the Personal Data Protection Act 2010 (“PDPA”), Green Soldier Biotech PLT which manages Biovae (referred hereinafter to as “Biovae”) values your privacy and strives to protect your personal information in compliance with the laws of Malaysia. Biovae is committed to prevent personal data of individuals being used in an inappropriate manner and will only collect and use your personal information in accordance with the relevant data protection laws (including the Personal Data Protection Act 2010), this policy and the privacy terms in your agreement(s) with any Biovae entity that you may have contracted with.

Biovae reserves the right to amend this policy at any given time and shall place a notice of such amendments on the website (www.biovae.com.my) or via any other method Biovae views suitable.

Biovae takes the matter of protecting your personal data as a high priority matter and your privacy matters to us, so please take the time to get to know our privacy practices.

 

General

The list below describes and explains the terms and conditions used in this policy:

  1. A data subject is any person whose personal data is being collected, held or processed. In simple terms, data Subject refers to individual who is the subject of the personal data.
  2. Personal data means information in respect of commercial transactions that relates to directly or indirectly to a Data Subject, who is identified or identifiable from that information or from that and other information in the possession of a data user, including any sensitive personal data, and expression of opinion about the Data Subject. Such personal information about or which identifies individual(s) who is the Data Subject, includes but not limited to individual(s)’ names, current and previous addresses, National Registration Identity Card (NRIC) number, passport number, bank account and credit card details, telephone and/or mobile numbers and/or facsimile numbers, photographs, and e-mail address and/or social media addresses.
  3. Processing in relation to personal data means collecting, recording, holding or storing the personal data or carrying out any operations or set of operations on the personal data.
  4. Sensitive personal data means any personal information consisting of information including but not limited to the physical or mental health or condition of a Data Subject, his political opinions, his religious beliefs or other beliefs of a similar nature, the commission or alleged commission by him of any offence or any other personal data.

 

What Personal Data Are Collected and Processed

The list below shows the various types of personal data Biovae collects and processes which includes but not limited to:

  • Your name;
  • Your National Registration Identity Card (NRIC) number;
  • Passport number;
  • Current and previous addresses;
  • Bank account details;
  • Debit/Credit card details;
  • Telephone and/or mobile numbers and/or facsimile numbers;
  • Photographs;
  • E-mail addresses;
  • Social media addresses.

 

How and Why Your Personal Data Are Collected and Processed

Biovae processes your personal data only for specific and limited purposes. You agree that all personal data collected and/or processed by Biovae may include but not limited to the following channels:

  • Directly from you through online registration, online payment, feedback form, chat bot and/or conversations with you in person, from e-mail, social media and telephone;
  • From third parties such as your employees, related companies, credit reporting or credit reference agencies, service providers such as Google Analytics, government agencies or your representatives;
  • From publicly available sources of information;
  • From our own internal systems that automatically collect data such as login monitoring systems that track IP address and the type of web browser you use as examples;
  • Other sources to which you have given your consent to disclose your personal data.

Biovae processes your personal data only for specific and limited purposes. You agree that all personal data collected and/or processed by Biovae may include but not limited to the following purposes:

  • To communicate with you;
  • To inform you of our products and services updates;
  • To provide you with our products and services;
  • To respond to your inquiries and complaints and to resolve disputes;
  • To send you promotional materials;
  • For marketing and research purposes;
  • To better understand what interest you on our website;
  • To personalise and target content that fits your interests
  • For development of existing and new products and services;
  • To maintain and update our business infrastructure and systems;
  • To conduct research and survey;
  • To meet the disclosure requirements of any law binding on us;
  • For any other purpose that Biovae deem necessary and/or as required or permitted by any law, regulations,
    guidelines and/or relevant regulatory authorities.

 

Disclosure of Your Personal Data

As part of providing you with our products and services, we may need to disclose information about you and/or your accounts and/or facilities with us to third parties such as our agents, affiliates, service providers, suppliers, vendors, business partners, where necessary, and subject at all times to any laws (including regulations, guidelines and/or obligations) applicable to Biovae. The disclose of your personal data may include but not limited to the following purposes:

  • To carry out background verification checks on candidates for employment;
  • To carry out advertising activities, publicity, marketing campaigns and communication relating to Biovae;
  • To support our daily operations;
  • In anticipation of, and in the course of an actual or potential sale, reorganization, consolidation, merger, or amalgamation of all or part of our business or operations;
  • As required by law or by order of a court of competent jurisdiction or by any rule, direction or regulation of any regulatory or governmental authority or any other relevant authority to be disclosed.

 

Security of Your Personal Data

Biovae shall take appropriate and reasonable measures to protect your personal data from any loss, misuse, modification, unauthorised or accidental access or disclosure, alteration or destruction when processing personal data. Some notable measures to ensure the security of your personal information include: Secure Socket Layer (SSL) connection encryption; and regular backups of the database.

 

Retention of Your Personal Data

Biovae retains personal data for as long as necessary for its legitimate business purposes, and as otherwise permitted by applicable law. 

 

Acceptance of The Policy

By continuing to use our products or services or website you consent to Biovae for collecting, maintaining, processing, using and disclosing your personal data as described in this policy. You are given notice that the products and/or services offered by Biovae will only be made available to you upon your accepting and expressly consenting to the terms of this policy. By accepting the term of this policy, you shall be deemed to have expressly consented to the processing of your personal data by Biovae or any of its authorised agents, employees, partners and/or contractors for purposes as outlined. You hereby agree and accept that by registering and/or continuing to use the products and/or services, you authorise and consent to your personal data being collected, processed by and where required, disclosed to classes of third parties as identified by Biovae for the purposes of Biovae providing you with the products and/or services. For the avoidance of doubt, you also hereby explicitly consent to Biovae collecting and processing any sensitive personal data relevant to such purposes.

 

Withdrawal of Consent

Notwithstanding anything to the contrary, you may at any time withdraw your consent to Biovae collecting and processing any personal data of yours or to any part or portion of the same by sending to Biovae at the address given below a written notice of withdrawal and within the period prescribed under the PDPA. Biovae shall take all necessary measures to give effect to your withdrawal of consent, to the extent that such withdrawal does not conflict with any of Biovae’s other legal obligations. If you do not wish to have your personal data shared with any other party, or if you do not wish to be solicited for products or services offered by Biovae or any other parties including third parties, kindly inform us in writing at the communication information as given at the end of this policy.

 

Your Rights to Access and Correct Your Personal Data

At any time you have the right to:

  • Request access to learn about your personal data held and processed by Biovae;
  • Request the deletion (erasure) of your information. This may include anonymisation or pseudonymisation of some data instead of total deletion;
  • Withdraw or object to the continued use, processing or storing of your personal data;
  • Correct your personal data held and processed by Biovae.

 

Access to Your Personal Data

You shall, upon written request, be granted access to all personal data held or stored or processed by Biovae. To avoid confusion, “access” for the purposes of this provision shall mean notification of such personal data of yours that is processed by or on behalf of Biovae and to have a copy of such personal data communicated or conveyed to you in an intelligible form of Biovae’s choosing.

In accordance with the PDPA, and to the extent not limited by any other applicable law, we may:

  • Charge an administration fee for processing your request for access or correction to the Personal Data, in compliance to the fees stated in PDPA sub-regulation; and
  • Refuse to comply with your request for access or correction to the Personal Data and give you
    a written reason for such an action.

Please note that in certain situations Biovae may have to withhold access to your personal data, for example where your identity is unable to be confirmed or where information requested for is of a confidential commercial nature or in the event repeated requests are received for the same information.

 

Correction of Your Personal Data

You may at any time make a written request to Biovae at the communication information as given at the end of this policy to correct any personal data of yours that is inaccurate, incomplete, misleading or out-of-date and Biovae shall, upon receipt of your written request for correction(s), take all necessary measures to give effect to such correction(s).
